We’re asking you, the fans, to design the jersey for the third kit to be worn by the Chicago Fire! The object of the Chicago Fire Jersey Design Contest is for fans to submit original and creative designs for the new Chicago Fire third team jersey.
The Chicago Fire Jersey Design Contest (the “Contest”) is open only to legal residents of the state of Illinois, Wisconsin, Indiana and Michigan who are of legal age of majority (and at least 18 years old) at the time of entry and living in ZIP codes which fall within a seventy-five (75) mile radius from Bridgeview, Illinois. Employees, officers, and directors (including immediate family members (spouse, parent, child and sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of Chicago Fire Soccer, LLC (“Sponsor” or “Chicago Fire”), The Quaker Oats Company (“Quaker”), Major League Soccer, L.L.C. (“MLS”) or Soccer United Marketing, LLC (“SUM” and collectively with Sponsor and MLS, the “MLS Entities”) and each of their respective parent companies, affiliated companies, subsidiaries, licensees, distributors, vendors, dealers, retailers, prize suppliers, printers and advertising and promotion agencies, and any and all other companies associated with, or providing services in connection with, the Contest are not eligible to participate or win a prize. The Contest is subject to all applicable federal, state, and local laws, rules and regulations. Void where prohibited or restricted by law, rule or regulation.
HOW TO ENTER
Entrants in the Contest should submit an original design that best depicts the passion and pride of the Chicago Fire that will be used as inspiration for the new team third jersey (the “Design”). Specifically, entrants must download a template form for the Design from www.Chicago-Fire.com. This template form will include blank outlines for entrant’s Design. Using the template form, entrants must design the new team third jersey (front/sleeves/back). All entrants must also provide their complete name, date of birth, address, city, state, ZIP/postal code, telephone number and e-mail address. The Contest entry period begins at 12:01 A.M. Central Time (CST) on July 16, 2013 and ends at 11:59 P.M. CST on August 14, 2013 (the “Entry Period”). During the Entry Period, there are three (3) ways to enter the Contest as further described below: (i) via e-mail, (ii) in person or (iii) via mail. No other method of entry will be accepted. Limit of one (1) entry per person, e-mail address or household during the Entry Period, regardless of method of entry. In case of multiple entries received from any person or e-mail address or household, only the first entry received from such person or e-mail address or household will be considered. Entries that do not comply with these Official Rules will be void, eliminated and not eligible for consideration. All entries become the property of Sponsor and will not be returned.
E-mail. During the Entry Period, eligible entrants can send an e-mail with the subject line “Chicago Fire Jersey Design Contest” with an attached copy of their Design to firstname.lastname@example.org. Submissions must be in one (1) of the following formats: PDF, JPEG, GIF, and PNG. Sponsor will not accept files that exceed 2 MB in total file size. The e-mail must be sent from your personal e-mail account and also include all necessary information. Entrants must submit all requested information to be eligible. Incomplete entries are void. By successfully submitting your entry via e-mail, you will automatically receive one (1) entry into this Contest.
In-Person. During the Entry Period, eligible entrants can bring their Design to the Chicago Fire Main Office located at Toyota Park in Bridgeview, Illinois (the “Stadium”), Monday through Friday, between the hours of 9:00 A.M. CST and 6:00 P.M. CST. Entrants must submit all requested information to be eligible. Incomplete entries are void. By successfully submitting your entry in-person, you will automatically receive one (1) entry into this Contest.
Mail. During the Entry Period, eligible entrants may enter the Contest by hand-printing their complete name, date of birth, address, city, state, ZIP/postal code, telephone number and e-mail address on a 3”x5” postcard and mailing it with their Design in an envelope with proper postage affixed to: Chicago Fire Jersey Design Contest”, Toyota Park 7000, S. Harlem Avenue, Bridgeview, IL 60455. Mail-in entries must be postmarked by August 14, 2013 and received by Sponsor by August 19, 2013 to be eligible. Entrants must submit all requested information to be eligible. Incomplete entries are void. By successfully submitting your entry via mail, you will automatically receive one (1) entry into this Contest.
By entering the Contest, each entrant agrees that his or her Design is an original work of authorship created by him or her, and not previously published, released or distributed in any form, or entered into any other competition nor won any award, and he or she owns all right, title and interest in the Design as of the date of submission. The Design must be original. It must have been created solely by the entrant and never previously displayed or published. It must not be copied from, altered from, or be similar in appearance to any other art, photo, ad or published material. By submitting an entry, the entrant does not violate the intellectual property rights of any other person or entity. Modification of an existing design does not count as an original. Entries cannot defame or invade the publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights. If the Design contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, the entrant is responsible for obtaining and represents that he or she has obtained, prior to submission of the entry, any and all releases and consents necessary to permit the use and exhibition of the Design by Sponsor and the other MLS Entities for any future commercial purposes without restriction in the manner set forth in these Official Rules.
Sponsor reserves the right to disqualify any entry for any reason, including any entry it deems to be offensive, inappropriate, not in keeping with the Chicago Fire or MLS image or that is otherwise not in compliance with these Official Rules, in its sole discretion.
The Contest is governed by these Official Rules. By participating in the Contest, entrants agree to be bound by these Official Rules and the decisions of Sponsor, whose decisions are final on all matters relating to this Contest. Sponsor is not responsible for (i) lost, misdirected, misplaced, illegible, incomplete, or late entries or (ii) any act, failure to act, or delay regarding the transmitting or processing of entries. Sponsor reserves the right, in its sole direction, to cancel or suspend this Contest, or to substitute the prizes offered, without notice at any time and for any reason. Sponsor reserves the right to correct and amend any artistic elements of any entry to assist with preparation of a final digital version of the Design as set forth below.
Sponsor reserves the right, in its reasonable discretion to request that any entrant resubmit his or her entry which fails to comply with any of the Official Rules and/or to waive the Official Rules set forth herein on a case by case basis in its reasonable discretion.
All Designs must use the template form as well as include the following elements:
· The MLS League logo and the American Flag on the right sleeve and left sleeve of the jersey, respectively,
· The Chicago Fire logo (including MLS Cup Champions Silver Star) on the upper left front side of the jersey.
· The Quaker Man logo on the front side of the jersey.
Use of any Chicago Fire, MLS and/or Quaker name or logo, including but not limited to the Quaker Man logo (collectively “the Logos”) for any purpose other than for the Contest is strictly prohibited. Entrants agree not to modify or alter the Logos in any way including their proportions, colors, wording, or other elements. Further, entrant acknowledges that the placement of the Logos as described above and featured on the template form is fixed and permanent and entrant must have the Logos in the same identical size and location as the current Chicago Fire team jerseys. The entrant’s use of any of the Logos must be consistent with the overall guidelines set forth herein. All Logos are registered trademarks that shall remain the sole and exclusive property of their respective owners.
PUBLICATION AND ASSIGNMENT OF RIGHTS TO SUBMISSIONS
All submissions in connection with this Contest shall be considered “work made for hire.” Accordingly, by entering the Contest, entrants agree to assign all right, title, and interest, including copyright rights, in the Design to Sponsor. Entrants agree and acknowledge that the Design shall be the sole and exclusive property of Sponsor and Sponsor may grant to the other MLS Entities and their respective designees, the non-exclusive, royalty-free, and irrevocable and unlimited right and license to use, reproduce, copy, publish, display, distribute, perform, translate, adapt, modify, edit and otherwise exploit all or part of their entry, including but not limited to entrant’s name, voice, biographical information, likeness and photograph, and to incorporate it (in whole or in part) in other works in any and all markets and media now or hereafter known worldwide in perpetuity without additional compensation (or any profits derived from the sale, use or other application of the Design), notification, permission or approval by entrant (or his/her heirs and successors). By entering, you agree that the submission and any other portion of the entry may be used in promotions, advertisements, and any future commercial purposes without restriction for Sponsor and/or the other MLS Entities. Entrants warrant that they have the sole and exclusive right to grant such rights to Sponsor and that Sponsor’s reproduction, publishing, displaying, and/or other use of their entries, or any portions thereof will not infringe on any rights of third parties (any person or entity), including without limitation, copyright, trademark, defamation, privacy, publicity, or other personal or proprietary right, or create claims for false light, idea misappropriation, intentional or negligent infliction of emotional distress, or breach of contract. Sponsor shall have no obligation to copy, publish, display, or otherwise exploit the entry.
REPRESENTATIONS AND WARRANTIES
To be eligible, you agree to and represent that your Design will not contain, as determined by the Sponsor, in its sole discretion, any content that:
· is sexually explicit, lewd, or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
· promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
· is obscene or offensive; endorses any form of hate or hate group;
· appears to duplicate any other submitted entries;
· defames, misrepresents or contains disparaging remarks about other people or companies;
· contains trademarks, logos, or trade dress (such as costumes, distinctive packaging or building exteriors/interiors) owned by others, without permission; contains any personal identification, such as license plate numbers, personal names, email addresses or street addresses;
· contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission;
· except to those of Sponsor or MLS, contains or references any names, products or services of any company or entity, or promotes any brand, product or service of any company or entity;
· contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;
· contains look-alikes of celebrities or other public or private figures, living or dead;
· communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate or otherwise contains content which Sponsor in it sole discretion decides is inappropriate or objectionable; and/or
· violates any law, rule or regulation.
Entries that do not comply with the above requirements are not eligible and, if submitted, may be removed at any time in Sponsor’s sole discretion. Entrants agree to reimburse Sponsor and their respective affiliates in full with respect to any losses, damages, and expenses, including reasonable attorneys’ fees, which they may sustain from the breach of a representation or warranty made by the entrant or the use of any rights granted by the entrant to Sponsor hereunder. By entering, entrant warrants that the submitted entry complies with the entry requirements set out above as well as all other Official Rules of this Contest.
A committee composed of Chicago Fire and Quaker staff (the “Judges”) will judge all eligible entries received during the Entry Period based on the following items (the “Judging Criteria”): overall appearance, originality/creativity, style and quality of the Design. Sponsor reserves the right to not award any prize or all prizes if, in its sole discretion, it does not receive a sufficient number of eligible or qualified entries during the Entry Period. The decisions of Sponsor are final and binding on all matters relating to this Contest.
On or about August 19, 2013, the Judges will select the top five (5) Designs from among all submissions received during the Entry Period. Each entrant among the top five (5) entries is a finalist (each a “Finalist” and collectively, the “Finalists”). The Finalists chosen based on the Judging Criteria will have the opportunity to win a Grand Prize as described below. Once the Finalists are selected, each Finalist will work directly with the Chicago Fire’s creative team to develop their Design into an acceptable digital format.
There will be two (2) online voting periods. During the first period beginning on or about August 26, 2013 at 9:01 A.M. CST and ending on September 6, 2013 at 11:59 P.M. CST (the "First Voting Period"), fans will have the opportunity to vote for their favorite Design on www.Chicago-Fire.com from among the five (5) Finalists chosen by the Judges. The top three (3) Designs with the most votes following the First Voting Period will enter a second online vote. During the second period beginning on or about September 9, 2013 at 9:01 A.M. CST and ending on September 20, 2013 at 11:59 P.M. CST (the "Second Voting Period"), fans will have the opportunity to vote for their favorite Design on www.Chicago-Fire.com from among the top three (3) Designs following the First Voting Period. Limit ten (10) votes per e-mail address per day during the First Voting Period and Second Voting Period. Additional votes beyond the specified limit will be void. Votes or e-mail addresses generated by script, macro or other automated means or with the intent to affect the integrity of the voting process will be void. The Finalist that submitted the Design receiving the most votes during the Second Voting Period will be the winner of the Grand Prize (the "Grand Prize Winner") will be announced on or about September 23, 2013. In the event of a tie for the Grand Prize, the Judges will select the Grand Prize Winner amongst the tied entries based on the Judging Criteria described above.
All five(5) Finalists will receive two (2) Second Star Club tickets to a 2013 Chicago Fire home game at Stadium (for use by Finalist and one (1) guest) (the “Prize”) (Approximate Retail Value (“ARV”) of each Prize: U.S. $100). The Grand Prize Winner shall receive: (i) round-trip coach airfare for Grand Prize Winner and (1) guest to Portland International Airport from the nearest major airport to Grand Prize Winner’s home address (Grand Prize Winner and guest must travel together on same itinerary); (ii) two (2) tickets to a 2014 Chicago Fire vs. Portland Timbers game to be played at JELD-WEN Field in Portland, Oregon; (iii) two (2) nights double occupancy standard accommodations at a hotel in Portland, Oregon; (iv) tour of the adidas campus in Portland, Oregon and opportunity to meet with adidas jersey designers; and (v) a U.S. $500.00 allotment in the adidas employee store. (ARV of the Grand Prize: U.S. $2,200). Total ARV of all prizes: U.S. $2,700.
The Design of the Grand Prize Winner shall appear on the official adidas third team jersey worn by Chicago Fire players during select games throughout the 2014 MLS season. Sponsor and MLS expressly reserve the right to make changes to any submitted Design that may appear on jerseys to be worn Chicago Fire players in its sole discretion. The Chicago Fire official adidas third team jersey shall be revealed publicly on or about October 8, 2013.
Any difference between actual value and stated ARV will not be awarded. Prizes are awarded “AS IS.” Transportation to/from Stadium is not included and is the sole responsibility of the Finalists. Unless otherwise noted, transportation is not included in the Grand Prize. The Winners are fully responsible for any and all applicable federal, state, and local taxes (including income and withholding taxes). All costs and expenses associated with any prize acceptance and use not specified herein as being provided, including but not limited to additional lodging accommodations, any transportation costs, surcharges or passenger facility charges, luggage fees, meals, gratuities and other expenses incurred by accepting applicable prize are the sole responsibility of each Winner. Limit one (1) Prize per person, family or household. All prize details are at Sponsor’s sole discretion. Winner’s guest must be of legal age of majority in their jurisdictions of residence, unless accompanied by his/her parent or legal guardian.
The prizes consist only of the items listed, and are non-transferable and non-assignable, with no cash redemptions or substitutions except at Sponsor's sole and absolute discretion. Prize details and availability are subject to change, in which case Sponsor reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, at its sole and absolute discretion. Embargo dates and other restrictions may apply and are subject to change. Game dates and times are determined in the sole discretion of MLS and/or the Sponsor, as applicable, and may be subject to change. Seat locations will be determined by Sponsor. The terms and conditions of the tickets awarded as prizes will govern in the event a game is not played due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. Winner and his/her guest agree to comply with all applicable stadium regulations in connection with any prize. Sponsor and the applicable MLS Entities reserve the right to remove or to deny entry to Winner and/or his/her guest who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at any game. Released Parties (as defined below) will not be responsible for acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster that may cause the cancellation or postponement of any game. Grand Prize Winner and guest are solely responsible for securing any necessary travel documentation, including but not limited to a valid passport, if applicable. Released Parties will not be responsible if Winner and/or guest have any restrictions on their ability to travel as contemplated herein.
NOTIFICATION: The Grand Prize Winner will be notified by e-mail and/or telephone by the Sponsor (as determined by Sponsor in its sole discretion). In the event that any potential Winner does not respond to any such notification within two (2) days of issuance, a disqualification will result, the Prize will be forfeited and, at Sponsor’s sole discretion and time permitting, an alternate potential Winner may be chosen from among all remaining eligible entries or no prize will be awarded. Each potential Winner may be required to submit his/her valid social security number (if applicable) and/or other identification to Sponsor and will be required to execute, have and return an Affidavit of Eligibility and Release of Liability and, unless prohibited by law, Release of Publicity, upon receipt of Prize. A disqualification will result and prize will be forfeited if all required documents are not properly executed and returned within the specified period of time. Refusal or return of such documents as non-deliverable or potential Winner’s noncompliance with these Official Rules will also result in disqualification and prize forfeiture and, at Sponsor’s sole discretion and time permitting, may cause an alternate potential Winner to be selected from among all remaining eligible entries.
WAIVER OF LIABILITY/PUBLICITY RELEASE/INDEMNIFICATION
By participating in the Contest and submitting an entry, each entrant agrees to (i) be bound by these Official Rules, including all entry requirements, (ii) waive and release any and all claims against the Sponsor, the other MLS Entities, Quaker and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Contest, and all of their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Contest or from the receipt or use of any prize, and (iii) indemnify the parties referenced in (ii) above from all liability, clams or actions of any kind for injuries, damages, or losses to persons or property alleged to have been sustained in connection with this Contest, including, but not limited to, those arising from (a) of false endorsement or infringement of rights of publicity or privacy; (b) the receipt, ownership or use of any prize awarded; (c) any travel or prize-related activity; (d) any typographical or other error in these Official Rules or any other materials disseminated by Sponsor; and (e) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with any equipment, systems, networks, lines, satellites, servers, computers, or providers used by an entrant or Sponsor. Each Winner, by acceptance of Prize, grants to Sponsor, the other MLS Entities and each of their respective designees the right to publicize such Winner’s name, address (city and state of residence), photograph, voice and/or other likeness and prize information in any and all media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration, notification or permission, unless prohibited by law.
Non-Liability of Released Parties. Released Parties are not responsible for stolen, late, incomplete, illegible, misdirected, lost, damaged, garbled, delayed, undelivered, inaccurate, postage-due or garbled entries, email or photo. Entries that are incomplete, illegible, garbled, late, damaged, or corrupted are void and will not be accepted. Entries generated by a script, macro or other mechanical or automated means or by any means which subvert the entry process will be disqualified. Released Parties are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries, the announcement of any prize or in any Contest-related materials, or the cancellation or postponement of any Game. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to entrants’ or to any other person's computer related to or resulting from participating in this Contest.
Skill Contest. The Contest is a skill contest designed to increase consumer awareness of and interest in the Chicago Fire and Major League Soccer. This Contest may not be used for any form of gambling. In the event that the Contest is challenged by any legal or regulatory authority, Sponsor reserves the right to discontinue or modify the Contest, or to disqualify any entrants residing in the affected geographic areas. In such event, Released Parties shall have no liability to any entrants who are disqualified due to such an action.
Additional Disqualifying Events. Persons who tamper with or abuse any aspect of the Contest or attempt to undermine the legitimate operation of the Contest by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or Sponsor’s representatives or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Contest is unlawful and subject to legal action by the Sponsor, the other MLS Entities and/or their respective agents. Sponsor and the other MLS Entities shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Contest, and to resolve all disputes in their sole discretion. Released Parties (i) make no warranty, guaranty or representation of any kind concerning any Prize, and (ii) disclaim any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability, and fitness for a particular purpose). All disputes will be resolved under applicable U.S. laws in the County of New York, state of New York without giving effect to choice of law or conflicts of law principles (whether of the state of New York, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of New York. Sponsor’s failure to enforce any terms of these Official Rules shall not constitute a waiver of that provision.
The Sponsor and the other MLS Entities, as applicable, reserve the right, in their sole discretion, to cancel or suspend the Contest for any reason, including should virus, bugs, unauthorized human intervention, or other causes, such as fraud, misconduct, or technical failures, corrupt the administration, security, fairness, integrity or proper operation of the Contest. In the event of cancellation, Sponsor may elect to identify the Winners and award the Prizes from among all non-suspect, eligible entries received up to the time of such cancellation.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND MLS WILL DISQUALIFY ANY SUCH ENTRANT AND SPONSOR AND THE OTHER MLS ENTITIES RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
Email. In the event of a dispute as to the identity or eligibility of a Winner based on an e-mail address, the entry will be declared made by the “Authorized Account Holder” of the e-mail address submitted at the time of the entry provided he/she is eligible according to these Official Rules. The "Authorized Account Holder" is defined as the natural person to whom the applicable Internet service provider or other organization (such as a business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address.
Modification of Official Rules. Sponsor reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest.
If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
WINNERS’ LIST: For a list of Winners (available after October 15, 2013), mail a self-addressed stamped envelope to: Chicago Fire Jersey Design Contest Winners’ List, 7000 S. Harlem Ave. Bridgeview, IL 60455. Winner’s name requests must be received by October 31, 2013.
